HiFun Membership Service Agreement

Important Notice

Welcome to the HiFun Membership (hereinafter referred to as "HiFun Membership") service. To protect your rights, please read this Service Agreement (hereinafter referred to as "this Agreement") carefully in its entirety before using the HiFun Membership service, especially the sections in bold.

Unless you have read and accepted all the terms of this Agreement, please do not confirm (including but not limited to clicking agree, entering the purchase process, paying fees, etc.) this service. By clicking agree, purchasing, and/or using the HiFun Membership service, you are deemed to have read and agreed to be bound by this Agreement.

Article 1: Acceptance and Amendment of This Agreement

1.1 The contents of this Agreement include the main body of the Agreement, the "HiFun User Service Agreement," the "HiFun Privacy Policy," and various rules that HiFun Platform (hereinafter also referred to as "the Platform") has issued or may issue/update in the future (hereinafter collectively referred to as "Related Service Rules"). The Related Service Rules are an integral part of this Agreement and have the same legal effect as the main body of this Agreement. In the event of any conflict between the main body of this Agreement and the aforementioned rules, the main body of this Agreement shall prevail. Unless explicitly stated otherwise, your use of the HiFun Membership service is subject to this Agreement.

1.2 If this Agreement and Related Service Rules are revised due to business development needs, the revised terms will be published on the HiFun Platform. You can review the latest agreement terms on the platform. If you do not accept the revised terms after the platform has modified them, you may choose to terminate the use of the HiFun Membership service. Continuing to use the service will be deemed as acceptance of the revised Agreement.

Article 2: Definitions

2.1 HiFun Membership: Refers to the value-added network service provided by the HiFun Platform, which allows you to enjoy certain privileges, discounts, or participate in activities upon becoming a HiFun Member, subject to the content published on the HiFun Platform's relevant service pages and the actual services provided.

2.2 "User" or "You": Refers to the individual or single entity enjoying the HiFun Membership service provided by the HiFun Platform.

Article 3: Procedures for Becoming a HiFun Member

3.1 If you wish to use the HiFun Membership service, you must first log in to your HiFun account or register and log in to a HiFun account. After successfully logging in to your HiFun account, apply to activate the HiFun Membership service. If you choose to log in to HiFun with a third-party account, you must ensure the stability, authenticity, and availability of the third-party account. If you are unable to log in to HiFun due to issues with the third-party account (such as the third-party account being banned), you should contact the company that owns the third-party account. The HiFun account you use to log in when using the HiFun Membership service is the sole basis for HiFun Platform to confirm your identity.

3.2 You can activate the HiFun Membership service by completing payment on the service activation interface through a payment method recognized by the HiFun Platform. When activating the service, you should carefully check the account name, service type, and duration. If you mistakenly charge the wrong account or activate the wrong service or duration due to personal reasons, HiFun Platform will not refund the fees already collected.

3.3 Upon successfully activating HiFun Membership, you can enjoy multiple exclusive privileges and services, subject to the content published and actually provided on the relevant service pages of the HiFun Platform. Membership qualifications are calculated from the time the HiFun Membership service is activated. The specific duration can be viewed by logging into the HiFun Membership center page.

3.4 HiFun Platform may adjust the HiFun Membership service fee standards and privilege content from time to time according to business development changes. The adjusted membership service fee standards and privilege content will be displayed on the membership qualification payment page. You should promptly pay attention to and understand changes in privilege content and policies and understand and agree to the adjustments made by HiFun Platform. Before adjusting privileges, HiFun Platform may have granted or you may be enjoying certain service content or rights. You understand and accept that adjustments to these privileges by HiFun Platform may affect the rights you have enjoyed or are enjoying, and agree to use the service according to the adjusted privilege content without requiring HiFun Platform to bear any responsibility. If the service fee standards are adjusted, you will only be entitled to or continue your membership after paying the adjusted service fee standards. Users who have purchased membership services according to the original membership service fee standards do not need to pay additional amounts.

Article 4: Provisions Related to HiFun Membership Qualification

4.1 HiFun Membership service is limited to use by the account that applied and cannot be transferred between different HiFun accounts.

4.2 During the effective period of the activated HiFun Membership, if you voluntarily cancel or terminate the HiFun Membership qualification midway, the HiFun Membership fee will not be refunded.

4.3 After HiFun Membership qualification is canceled/terminated, you will no longer be able to participate in activities organized by the HiFun Platform related to membership or enjoy the various exclusive privileges and value-added services provided by the HiFun Platform, meaning you will no longer enjoy HiFun Membership services.

Article 5: HiFun Membership Usage Rules

5.1 You confirm: You are a natural person, legal person, or other organization with full civil rights capacity and full civil conduct capacity, capable of independently assuming responsibility for all actions taken in using HiFun Membership services.

5.2 You are solely responsible for properly managing, using, and maintaining the account, account information, and account password you obtained from the HiFun Platform, and for all activities and actions taken with that account. It is prohibited to give, lend, rent, transfer, or sell the account. HiFun Platform will not be liable for any responsibility related to the leakage of your account password or losses caused by improper management, use, or maintenance not attributable to HiFun Platform.

5.3 You should comply with this Agreement and HiFun related service rules. If your membership service is suspended and/or terminated due to violation of this Agreement or related service rules, you shall bear the resulting losses.

5.4 If you engage in any of the following behaviors, HiFun Platform has the full right to terminate the provision of HiFun Membership services without notifying you and has the right to restrict, freeze, or terminate the use of the HiFun account associated with the service. HiFun Platform does not need to provide any compensation or refunds, and you will be solely responsible for any resulting liabilities. If your actions cause losses to HiFun Platform or third parties, you must compensate in full:

(1) Obtaining HiFun Membership services for yourself or others for profit, business, or non-personal use purposes;

(2) Obtaining HiFun Membership services using any robot software, spider software, crawler software, screen-swiping software, or other irregular methods;

(3) Obtaining HiFun Membership services through improper means or by actions that violate the principle of good faith;

(4) Registering or using HiFun Membership for yourself or others by infringing on the legal rights of HiFun or others;

(5) Providing the HiFun Membership account to third parties for use in any form, including renting, lending, or selling;

(6) Using any content obtained through HiFun Membership services for purposes other than personal learning, research, or appreciation.

5.5 To prevent malicious account sharing or account theft and protect your account security, you understand and agree that HiFun Platform may impose certain restrictions on the number of devices logging in and using the same HiFun Membership account. The same account can only be used on one device (regardless of mobile or non-mobile devices) at the same time.

5.6 If any of the following situations occur, HiFun Platform has the right, based on the actual situation, to interrupt or terminate one or more or all services provided to you without notifying you. You shall bear any resulting losses, and HiFun Platform will not provide any compensation or refunds. If your actions cause losses to HiFun Platform or third parties, you must compensate in full:

(1) The personal information you provided is untrue or inconsistent with the information provided at registration, and you fail to provide reasonable proof;

(2) It is confirmed by a valid legal document issued by a national administrative or judicial authority that you have engaged in illegal, infringing, or wrongful acts, or HiFun Platform, based on its judgment, believes that your behavior is suspected of violating the "HiFun Service Terms," this Agreement, or usage rules published by HiFun Platform from time to time, or is suspected of violating the provisions of laws, regulations, and policies;

(3) Your behavior interferes with the normal operation of any part or function of HiFun;

(4) You use HiFun to carry out any behavior that requires HiFun Platform's consent without permission from HiFun Platform, including but not limited to commercial activities through HiFun, such as adding advertisements, commercial content, or links;

(5) Your personal information, published content, or behavior in using HiFun Platform services violates national laws and regulations, violates social ethics, public order, good customs, or infringes on the legal rights of others, has a strong political color, causes any controversy, or violates this Agreement or the requirements published by HiFun Platform;

(6) You use HiFun Platform to carry out any illegal activities.

Article 6: Disclaimer of Liability

6.1 If you exercise the rights stipulated in this Agreement to purchase or accept goods or services provided by third-party merchants outside the HiFun Platform, and a dispute arises as a result, you should assert your rights with the third-party merchant that sold or provided the goods or services. This matter is unrelated to the HiFun Platform.

6.2 You shall bear full legal responsibility for all actions you and your invited guests take when participating in activities organized by the HiFun Platform or when using the discounts and value-added services provided by the HiFun Platform.

6.3 The HiFun Platform shall not be liable for any loss caused by the actions or inactions of third parties, or for losses due to force majeure, including but not limited to payment services, network access services, communication line failures by telecommunications departments, communication technology issues, network or computer failures, system instability, or any third-party infringement.

6.4 You understand and agree that during the use of the HiFun Membership service, you may encounter risks such as force majeure that may cause interruptions to the service. In the event of such circumstances, the HiFun Platform promises to cooperate with relevant parties to carry out repairs as soon as possible but shall not be responsible for any loss caused to you, nor will it refund the HiFun Membership fees.

Article 7: Other Provisions

7.1 Service Suspension, Interruption, and Termination: The HiFun Platform may choose to change, suspend, interrupt, or terminate the HiFun Membership service due to its own business decisions, government actions, force majeure, or other reasons. In the event of such circumstances, the HiFun Platform will notify you, but except as otherwise provided by laws and regulations or stated by this platform, the HiFun Platform will not be liable for any loss caused to you. At the same time, except as otherwise explicitly provided by law, HiFun has the right to directly refund the fees corresponding to the unfulfilled HiFun Membership service without your application.

7.2 All notifications sent to you by the HiFun Platform can be made through in-site messages, website announcements, public account notifications, emails reserved by you, SMS, letters, etc. Such notifications shall be deemed delivered to the user on the date of sending. Please make sure to pay attention to the notifications sent by the HiFun Platform.

7.3 Governing Law and Dispute Resolution: This Agreement shall be governed by the laws of the People's Republic of China, excluding any conflict of law rules. If any dispute arises regarding the signing or performance of this Agreement, both parties shall attempt to resolve it amicably through negotiation. If negotiation fails, either party may file a lawsuit in the People's Court with jurisdiction over the defendant's domicile.

7.4 The failure of the HiFun Platform to exercise, or timely exercise, or fully exercise any rights under this Agreement or according to the law shall not be construed as a waiver of such rights, nor shall it affect the HiFun Platform's right to exercise such rights in the future.
